The report discusses the principles of positive obligations on states as inherent to some of the articles of the ECHR, specifing how these apply to art. 10 of the ECHR. The ECtHR has interpreted this, given the key importance of freedom of expression as one of the preconditions for a functioning democracy, af the fact that states must ensure that private individuals can effectively exercise the right of communication between themselves. The text then present key case-law such as Fuentes Bobo v. Spain, Özgür Gündem v. Turkey, Appleby and Others v. the United Kingdom, Dink v. Turkey and Palomo Sánchez and Others v. Spain.
