UK: Ruling against inadvertently identifying a victim of sexual assault based on social media image

by Cristina BachmeierIn its decision in early March, the Westminster Magistrates Court found a British newspaper, The Sun, guilty of breaking the Sexual Offence (Amendment) Act after inadvertently identifying a victim of sexual assault. The newspaper published a picture, which had been obtained from the social media platform Facebook, showing the victim together with the prominent perpetrator. The image of the victim had been heavily obscured by the newspaper and the article contained a warning that identification of the victim online and on social media would be followed by prosecution. LuxLeaks Whistleblower to Appeal the Guilty Verdict

Antoine Deltour successfully avoided jail but was found guilty for theft by a court in Luxemburg following a case related to the prosecution of two whistleblowers and a journalist for disclosing confidential documents from auditing firm PwC that showed how 340 multinational companies used secret tax deals to avoid paying into the public coffers. On June 29, the 12th chamber of the Criminal Court of Luxembourg sentenced Deltour to a suspended 12-month jail time and a 1,500 € fine. He is appealing the decision. Luxemburg: The LuxLeaks Trial

by Annelies VandendriesscheAntoine Deltour, Raphaël Halet and Edouard Perrin, three French nationals, were brought before the Correctional Tribunal of Luxembourg on April 26th 2016 in what is commonly referred to as the LuxLeaks Trial. At stake are the preservation of professional secrecy on the one hand, and freedom of the press and protection of whistleblowers on the other. The three men are accused of leaking over 30 000 confidential documents revealing the tax deals concluded by large multinational companies with the Luxembourgish fiscal authorities. The European Centre for Press and Media Freedom supports an international campaign which aims to protect non-EU journalists against mass surveillance by the German Federal Intelligence Service (Bundesnachrichtendienst, BND). Coordinated by Reporters without Borders (RSF), different German and international media freedom and human rights organisations jointly speak out to stop the current draft of the law. The draft which is at present discussed by the German Bundestag would allow the wiretapping of foreign journalists and other professionals trusted with secret information (e.g. doctors) when this serves the political interest of the German state. Germany: German university in Mainz has to release sponsor-contracts worth several millions

by Ingo Beckendorf The German Johannes Gutenberg-university in Mainz is obliged, to release its contracts with a sponsor to a journalist. That was decided by verdict of the Mainzer administrative court on May 11th 2016 (Az.: 3 K 636/15). In the case, the chief-reporter of the German public broadcaster “Südwestrundfunk” (SWR), Thomas Leif, brought an action against the university for the release of documents regarding the cooperation-contracts between the pharmaceutical cooperation Boehringer-Ingelheim and the university.
